1.1. Introduction. These Terms and Conditions (hereinafter referred to as the “Agreement”) constitute a legally binding agreement between AvaHost S.R.L. (hereinafter referred to as “AvaHost”, “Company”, “we”, “us”, or “our”) and the individual or legal entity purchasing or using our services (hereinafter referred to as “Client”, “Customer”, or “Subscriber”).

1.2. Acceptance of Terms. By accessing the AvaHost website, purchasing services, or utilizing any part of our infrastructure, the Client explicitly acknowledges that they have read, understood, and agreed to be bound by this Agreement. If the Client does not agree to these terms, they must immediately discontinue the use of our services.

1.3. Modification of Terms. AvaHost reserves the right to modify, update, or alter these Terms and Conditions at any time without prior notice. Continued use of the services following any changes constitutes acceptance of the revised Agreement. It is the Client’s responsibility to review this document periodically.

1.4. Service Scope. AvaHost provides web hosting solutions, including but not limited to Shared Hosting, VPS (Virtual Private Servers), Dedicated Servers, and Domain Registration. The Company guarantees to provide these services with due diligence and in accordance with industry standards.

2. PERSONAL DATA PROTECTION

In accordance with our commitment to security and transparency, the following protocols govern the protection of your data:

We are committed to protecting information stored with us and employ a variety of security technologies and measures intended to protect it from unauthorized access. However, we advise you to keep your information encrypted. Ensuring data security on servers is one of the key aspects of our work, and we implement a comprehensive security strategy that encompasses various measures to safeguard your data. Regarding the processing of your financial information and credit card information in particular: for this matter, we use third-party payment processing companies which collect and store your financial information. AvaHost does not directly store full credit card numbers on our servers, ensuring an additional layer of security by leveraging compliant payment gateways.

The only circumstance under which we are obliged to disclose your personal data is when we receive a legal request from the Moldova Republic state agency which was issued under an appropriate Moldova Republic law. This question deserves special attention, and we strictly verify the validity of such requests to ensure they comply with local jurisdiction before any data is released. When you register to use the Services, communicate with our customer service team, send us an email, or post on our blog, you’re giving us information that we collect. That information may include your IP address, name, physical address, email address, phone number, and billing information. By giving us this information, you consent to your information being collected, used, disclosed, and stored by us, only as described in our Terms of Service and Privacy Policy.

3. PRIVACY POLICY

3.1. Data Collection. We collect data necessary for the provision of services, technical support, and billing. This includes Personal Identifiable Information (PII) such as names, addresses, and email addresses, as well as technical data like IP addresses and server logs.

We may share generic aggregated demographic information not linked to any personal identification information regarding visitors and users with our business partners and advertisers for the purposes outlined above.

4. ORDER PLACEMENT AND PAYMENT METHODS

4.1. Placing an Order. Services can be ordered directly through the AvaHost website. The Client must provide accurate and complete information during the registration process. Providing false contact information of any kind may result in the termination of your account.

4.2. Agreement to Terms during Checkout. Mandatory Checkbox: On the website/app payment page (checkout interface), a checkbox specifically designating the acceptance of these Terms and Conditions is present. The Client must check this box to acknowledge their agreement. The system is designed such that proceeding to online payment is technically impossible without this explicit confirmation.

4.3. Payment Methods. AvaHost accepts a variety of payment methods to ensure convenience for our global client base. These include, but are not limited to:

  • Credit/Debit Cards (Visa, MasterCard)
  • PayPal
  • Webmoney
  • Cryptocurrency

4.4. Billing Cycles. Services are billed in advance on a recurring basis (monthly, annually, etc.) depending on the plan selected by the Client. Failure to renew the service by the due date may result in suspension and eventual termination of the service.

5. DELIVERY CONDITIONS

5.1. Digital Delivery. All services provided by AvaHost are digital. No physical products are shipped.

5.2. Activation Time. Upon successful receipt of payment, the service is generally activated immediately. However, in some cases (such as Dedicated Servers or instances requiring manual verification for fraud prevention), activation may take up to 24-48 hours.

5.3. Credentials. Access details, including usernames, passwords, and IP addresses, will be delivered to the email address registered by the Client. The Client is responsible for maintaining the confidentiality of these credentials.

5.4. Delivery Confirmation. The timestamp of the email containing the access credentials serves as the proof of delivery.

6. RETURN POLICY

STANDARD RETURN TERMS Full refund option available within 30 days of purchase, giving you plenty of time to test their overall performance. AVA HOST reserves the right to return money to our customers for purchases made using credit cards, Webmoney or PayPal to the original account. Please note that AVA HOST has no control over any additional fees that PayPal or credit card companies may charge, so you will need to contact them directly.

Please note: Only first-time hosting accounts are eligible for our 30-day money-back guarantee. For example, if you previously purchased a shared hosting package and canceled it for a refund, you will not be eligible for a further refund of the shared hosting price. Additional licenses for third party software (such as cPanel or Softaculous) are non-refundable.

TRANSACTION DATE In this policy, “Transaction Date” is defined as the date on which a product or service is purchased, including the date on which renewal occurs under the terms of the applicable product or service agreement (Terms of Use). You can always cancel a product, but a refund will only be issued if the cancellation request is made within the product-specific deadline, if any. It should be noted that some products may have separate return policies or restrictions, including those products for which refunds are absolutely not possible.

PRODUCTS FOR WHICH NO REFUNDS ARE PROVIDED:

  • Domain Names 
  • Services purchased with promotional codes or discounts are also non-refundable.
  • SSL Certificates

In cases where a promo code reduces the price of a hosting package, the order is considered final and cannot be canceled for a refund. Special promotions and limited-time offers are provided under strict no-refund terms, regardless of the service type.
